Terms & Conditions Forex Card

By purchasing the Paul Merchants Global Currency Card you confirm that you, the cardholder, are age eighteen (18) years or over (or where the cardholder is over twelve (12) but less than eighteen (18) years old, the application form and acknowledgment has also been duly signed on the cardholder’s behalf by their parent or legal guardian) and you agree that you understand, accept & shall comply with these Terms and Conditions and the table of fees and limits mentioned herewith.

Meaning/ Abbreviations

In these Terms and Conditions, the following words have the meanings set out hereunder, unless the context indicates otherwise:

  1. “Activate and Activation” refers to the activation of the Card to enable you to use the Card.
  2. “PAUL MERCHANTS Branch”: Any Branch of PAUL MERCHANTS, from which you have purchased the card within India designated for the issuance, reload and encashment of this PAUL MERCHANTS GLOBAL CURRENCY CARD.
  3. “ATM” means an Automated Teller Machine on a shared network, at which, amongst other things, the cardholder can use their Card to withdraw cash.
  4. “ “Card” means the Paul Merchants Global Currency Card with ATM and merchant access and functionality, as set out in the Agreement
  5. “Customer Care” means any services, including call centre services, provided by us or our third party service provider in connection with the Card.
  6. “Card balance” means the aggregate** sum of all Currency records maintained by us (or by service providers on our behalf) of the funds loaded onto your Card in each Currency and available for transactions.
  7. “Currency” means, any one (1) or more of USD, GBP and EUR and any additional currency that Paul Merchants Limited may make available in connection with the Card from time to time.
  8. “Inactivity” means any period of non-use of the Card for withdrawals at ATMs, purchase transactions at merchant locations or purchase transactions on Internet.
  9. “Merchant or Merchant Establishments” shall mean establishments, wherever located, which accept ⁄ honor the Card as a means of payment.
  10. “Cardholder Portal” means the portal which will be available to you for accessing the balance(s) on your card into each wallet(s), transaction statement, resetting the pin.
  11. “PIN” means a unique Personal Identification Number, associated with each Card.
  12. “POS” means Point of Sale electronic data capture terminals at Merchant Establishments, capable of processing transactions and at which the cardholder can use the Card to make payment for their purchases.
  13. “Transactions” shall mean cash withdrawals from the ATMs and/ or purchases made at the Merchant Establishments and/ or purchase transactions on Internet through the use of the Card.
  14. “Replacement Card” means any Card provided to you, in accordance with this Agreement, to replace a lost, stolen or damaged Card.
  15. “Security Details” means some of the information given by you when applying for the card or any changes made to this information by you subsequently by contacting Paul Merchants Limited.
  16. “Shared Network” shall mean ATMs which are not owned by Master Card but which accept cards issued by Master card.
  17. “Shortfall” occurs in certain circumstances when the Card Balance drops below zero (0) and your Card Balance is overdrawn.
  18. “Schedule of Charges and Limits” means the table of fees and limits set out herewith, and any fees or limits updated in accordance with this Agreement which can be referred on the website.
  19. “We”, “us”, “our” means Paul Merchants Limited., hereinafter referred to as Paul Merchants, a company incorporated under the governing laws of the Republic of India and registered under the Companies Act 1956/ 2013 and carrying on Foreign Exchange business in terms of the “Authorized Dealer Category II” license issued by The Reserve Bank of India (“RBI”) and having its registered office at DSM 335, 336, 337, 3rd Floor, DLF Tower, 15,  Shivaji Marg, Najafgarh Road, New Delhi -110015
  20. “Wallet or Currency Wallet” is a store of value within your card, the value of which is equivalent to the available card balance in the denominated currency of such wallet.
  21. “You”, “your” means the Cardholder i.e. purchaser of the Card.
  22. Any references to ‘Card’ also include any Secondary Card or Replacement Card, where appropriate.

*Applicable only for dual card kit.

** Aggregate means “forex amount loaded and reloaded less any amount spent or refunded and any applicable fees, charges, conversion fees & other expenses incurred in connection with use or possession of the card”.

ISSUANCE OF CARD

  1. The Card may be purchased and held by residents of India only. An individual or corporate business can purchase the Paul Merchants Global Currency Card (for use by itself, its authorized employees or representatives of the corporate business), subject to compliance by the Card applicant of the provisions of applicable Laws (including the Foreign Exchange Management Act, 1999), rules, regulations and directions as issued by RBI or other appropriate Regulatory authorities under any law in force from time to time and also by MasterCard.
  2. The applicant of the Card is required to complete and submit a duly signed application form as required by Paul Merchants Limited at the time of purchase/ initial load and/ or subsequent reloads and further to submit all such documents as may be necessary or required.
  3. Upon issuance of the Card, the cardholder shall sign on the reverse of the Card.
  4. The Card can be loaded in any available currency and such list of available currencies may vary from time to time. If we introduce a new Currency, you will be deemed to have acknowledged and agreed that, unless otherwise notified to you, these Terms & Conditions applies to such new Currency also.
  5. You are responsible for determining the amount held in each Currency and for ensuring you have sufficient funds for all transaction.
  6. There is no interest payable to you on the balance and the Card Balance does not amount to a deposit with us.
  7. The issue and use of the Card, in addition to the present Terms & Conditions, shall be subject to rules and regulations laid down by RBI, FEMA, PMLA and MASTERCARD from time to time.
  8. Card load or reloads will only be credited to the Card Balance, only on receipt of funds & satisfactory compliance requirements in accordance to rules and regulations laid down by regulatory authorities and Paul Merchants Limited, from you.

 

USAGE OF CARD

  1. The turnaround time for Card activation and funding is up to 24-48 hours (subject to point 9 mentioned above under Issuance of Card). Due to FEMA regulations, the Card cannot be used at ATMs or merchants in India, Nepal, Bhutan, Pakistan and Countries under UN sanctions like North Korea, Cuba, Sudan, Iran etc. or for internet purchases where the website is registered in India, Nepal, Bhutan or at website accepting payment in Indian Rupees or the currencies of Nepal, Bhutan, and countries under UN sanctions like North Korea, Cuba, Sudan, Iran etc. In case there is a change in entitlements as notified by the Reserve Bank of India to the general public, the changed entitlements would be applicable.
  2. The Card can be used worldwide wherever MasterCard cards are accepted or you see the Mastercard Acceptance mark at ATMs and merchants, including shops, restaurants and online, provided there are sufficient funds available on the Card for the transaction, including any applicable fees, subject to any restrictions as mentioned herein

Notwithstanding the above, the card may not operate in some locations, where Mastercard acceptance mark is displayed, including some countries, due to restrictions and/ or sanctions as per law of land. In addition, please note that the Card is for use in electronic terminals or ATMs and will not work in manual or offline terminals.

  1. The applicable currency balance (and therefore the total Card Balance) will be debited with the amount of each cash withdrawal or transaction and any fee, and these debits will reduce the balance of the applicable currency wallet (and therefore the total Card Balance). Each transaction will require authorization or validation before completion and we cannot stop a transaction once authorized.
  2. If there are insufficient funds in a particular currency wallet to pay for a transaction, the system will look for the full transaction value in the subsequent other currency wallets held on the Card after which the transaction will be automatically processed. If there are insufficient funds in any of the currency wallet to pay for a transaction in full, then the card will be declined.
  3. The Card is only for your use till the date of expiry printed on the card. Upon expiry you will not be able to use the Card. Please contact Customer Care or your nearest Paul Merchants Limited branch for a renewal Card. Upon expiry, you will still be able to obtain a refund of the balance in accordance with the Agreement, or you may choose to transfer the balance funds to a new Card. You may be charged for this service.
  4. You agree not to use the Card for money transfers, accessing or purchasing goods from adult or gambling locations or internet sites, or for any unlawful activity and you will be solely liable, answerable and responsible for any unauthjorized use of the card. You further hereby agree to indemnify Paul Merchants Limited and its Directors/ Officers against any loss or damage caused by unauthorized usage of the Card, including any penal action arising there off, on account of any violation of RBI guidelines or rules, framed under the Foreign Exchange Management Act (1999), any laws being in force in India or the country of use. You must comply with all laws and regulations (including any foreign exchange controls) in respect of the Card in the country of purchase and/ or cash withdrawal.
  5. It is not recommended to use the Card as:
    1. A guarantee of payment. For example as a deposit for hotels (pre Authorization), or car rental or cruise lines, as merchants such as these may estimate the final bill and this amount will be temporarily unavailable to access or spend.
    2. As an arrangement for periodic billing, as any debits to the Card as a result of such arrangements
  6. If the Card is lost or stolen while you are travelling, you may contact Customer Care of Paul Merchants Ltd. to block the card or request a new Card (“Replacement Card”), subject to an applicable fee. If you are in INDIA and require a Replacement Card because your Card has been lost or stolen, you need to visit your nearest Paul Merchants Limited Branch. Our Branch can also provide a replacement Card in the event your Card is due to expire. You must make this request to our Branch on or before the expiry of the Card and the balance of the Card will be transferred to the Replacement Card.
  7. An inactivity fee will be charged in case the card is not active, as per the schedule of charges.
  8. The Card can only be used if it is in Credit. If a Shortfall arises, following any transaction authorized by you, the resulting debit balance immediately becomes a debt, payable by you to us and we retain the right to recover this debt by deducting funds held in another Currency on the card. When we convert the Shortfall into the relevant currency, the exchange rate used will be the rate determined by us on the given day we process the transaction. If notwithstanding any such deduction, a Shortfall remains, the resulting debit balance immediately becomes a debt payable by you to us and you agree to reload the Card to bring the balance back to zero (0) or above, within thirty (30) days of the request. A Shortfall fee may also be payable if a particular Currency and/ or the Card Balance drops below zero (0) (see Schedule of charges). If the Card Balance drops below zero (0), you must not make any subsequent transactions.
  9. Purchases abroad, which may be considered investments or imports (which as such, are subject to specific regulations), are not permitted.
  10. Any usage of the Card which is inconsistent or in contravention with the usage described in these Terms & Conditions is not permitted.
  11. If you are entitled to a refund for goods or services purchased using the Card, or similar other credit for any other reason, this will be made to the Card, in the applicable Currency wallet as and when it is received from the merchant. Paul Merchants Limited  accepts no responsibility and or liability for any delay caused in this regard, for any reason whatsoever.
  12. If your Card can be reloaded during the period of the Card validity, within the limits prescribed by Foreign Exchange Management Act (1999), reloads will also be subject to any restrictions imposed by legal or regulatory requirements in place from time to time. Where your Card has been issued to you at the request of your employer for business-related travel, you agree that the authorized employer nominated on the application form can reload additional funds at any time, within the above restrictions or encash the balance available in the card.

KEEPING YOUR CARD & PIN SECURED

  1. You must sign at the back of the Card as soon as you receive it.
  2. You must do all that you reasonably can to keep the Card safe and the PIN and other Security Details secret and safe from misappropriation by any third party at all times. Paul Merchants Limited will have no liability to you for any losses that you may suffer as a result of your Card getting misused.
  3. We will never contact and ask you to reveal any Card credentials like CVV, PIN and Expiry date*.
  4. The PIN may be disabled if an incorrect PIN is entered three times. If the PIN is disabled, cardholder need to reset the PIN by login into customer portal or call customer care for the same. However, PIN can also be auto reset after 24 hours until then the cardholder will not be able to use the PIN for any transaction on ATM or any POS terminals.
  5. You must call Customer Care of Paul Merchants Ltd immediately, & without undue delay, if you lose the Card and/ or believe it could be misused or you suspect that someone else may know the PIN or any other Security details. We will suspend the Card to prevent further use. If a lost Card is subsequently found, it must not be used.
  6. You will be required to confirm details of any loss, theft or misuse to Customer Care of Paul Merchants Ltd in writing and you must assist us and the police in any enquiries.
  7. We may suspend the Card, with or without notice, if we think the Card has been or is likely to be misused, if you have breached any of these terms or if we suspect any illegal use of the Card. If we do suspend the Card, we will inform you of our decision, unless such disclosure is prohibited by law or would otherwise compromise fraud prevention or security measures.
  8. You must memorize the PIN. For security purposes, you should not keep the PIN written anywhere near the Card. If you forget the PIN, contact our Customer Call Centre.

* Expiry date can be asked by customer care of Paul Merchants Limited only to verify the cardholder at the time of the call, when the cardholder contacts the customer care for any assistance.

CARD FEES & LIMITS

  1. You agree to pay and authorize us to debit the Card Balance for the fees set out in the Schedule of Charges. These fees may be debited from the Card Balance as soon as they are incurred. All fees will be debited in the respective Currency, unless specified in Schedule of Charges, wherein the default wallet will be debited for fees, like Inactivity fees. If there are insufficient funds within this Currency to pay such fees, or the Local Currency is not a Currency available on the Card, then we will automatically deduct funds from USD or other Currencies as applicable. Any such deduction of the fund may be subject to a fee (refer to the Schedule of Charges).
  2. Fees are applicable to the Card, as indicated in the Schedule of Charges. These fees which are charged are subject to change from time to time. You may be notified of any change in the applicable fees directly. For business travellers, purchasing a Card within a corporate program, standard fees apply as per the Schedule of Charges, unless a Corporate is offered a special fee.
  3. From time to time, we may limit the amount you can load on the Card or the amount you can withdraw from ATMs or spend at merchants over certain time periods. Some merchants and ATM operators also impose their own limits on the amount that can be spent or withdrawn over a specific time period.
  4. Certain ATM operators or merchants may charge an additional transaction fee if the Card is used to make a withdrawal or to purchase goods and/ or services. The fee is determined and charged by the ATM operator or merchant and is not retained by us.
  5. These limitations will vary for every ATM, Shared Networks and/ or Merchant Establishments. We shall not be responsible for either ascertaining, nor notifying the Cardholder as to such limits/ restrictions and shall not be liable for any loss suffered by the Cardholder due to these restrictions, limitations or to a lack of uniformity between transactions requested at ATMs, Shared Networks and/ or Merchant Establishments.

LIABILITY FOR UNAUTHORIZED TRANSACTIONS

  1. We bear no liability or answerability for any unauthorized use of the Card. It is your sole responsibility and liability to ensure that details of the PIN are not disclosed to anyone else and to maintain the sole custody of the PIN and the Card at all times.
  2. Paul Merchants Limited records of transactions processed by the use of the Card shall be conclusive and binding for all purposes.
  3. If you notice an error in any Card transaction or a Card transaction that you do not recognize, you must notify Customer Care immediately and in any event within thirty days of the transaction debit date. We will request that you provide additional written information concerning any such Card transaction and you must comply with such request. We recommend that you check your transaction history and balance at frequent intervals.
  4. You will be solely and fully liable for all losses in respect of the Card if you have
    1. Acted fraudulently
    2. Failed to use the Card in accordance with these terms and applicable law of land
    3. Failed to notify Customer Care without undue delay on becoming aware of the loss, theft or misuse of the Card, and in any event within thirty days of the transaction.
    4. Failed to take all reasonable steps to keep the Card’s security features safe.
  5. Once the card and PIN are in your possession, its usage becomes your sole responsibility and answerability and we are not liable for any kind of usage including fraudulent or unauthorized use of your Card. If you ask us to investigate a transaction and our investigations conclude that the transaction you have disputed has been authorized by you or on your behalf, or you have acted fraudulently, we may charge you an investigation administration fee for the said investigations.

CARD BALANCE/ RELOAD

  1. If an ATM displays Card Balance, then this may be displayed in USD or in a different currency, in which case the exchange rate applied may be different to ours and discrepancies can arise. An ATM will not display a balance for each Currency. An accurate balance for each Currency can be obtained through Customer Care or by logging in to the customer portal.
  2. Reloading of the Card: Until the expiry of the Card, you can reload/ add funds to each Currency through the Branch or through other methods made available from time to time by us, subject to the compliance of all applicable laws, rules and regulations, directions in force from time to time upon submission of prescribed forms and information/ documents as required. Branch will advise you of the acceptable methods of payment and required documents/ information. Amount of funds loaded on the Card shall be in strict accordance to the limits specified by the applicable laws, rules and regulations in force from time to time.
  3. We reserve the right to
    1. Limit the amount of value that can be reloaded on Card.
    2. Limit the number of times the value can be reloaded onto the Card Balance.
    3. Decline a reload transaction, at our sole discretion.
  4. You may also be able to make balance enquiry at some ATMs, although availability is dependent on the country and the ATM used. Balance Enquiry at ATM could attract fees, as applicable fees for each currency, which can be referred from Schedule of Charges.
  5. Information sent over the internet may not be completely secure and the internet and the online systems are not controlled or owned by us, or our third party service providers. Therefore, neither we, nor our third party service providers, can guarantee that they will function at all times and we, and our third party service providers, accept no liability for unavailability or interruption, or loss of Personal Information or any other data.
  6. Paul Merchants Limited will block up to USD 10 equivalent on the card to prevent the card balance going into negative balance due to tip adjustment by the merchant at a later date. The blocked amount can be refunded in INR at the Branch after completion of your foreign travel subject to the last transaction date should be with gap of 10 days or more. Paul Merchants Limited reserves the right to change the value of blocked amount from time to time as per its internal policies.
  7. If the Cardholder has received funds in excess of the card funds, the Cardholder agrees to promptly repay Paul Merchants Limited any such funds upon such terms and conditions as Paul Merchants Limited may specify. If Paul Merchants Limited has grounds to believe that the Cardholder has received funds in excess of the card funds requested by the Cardholder, due to any reason whatsoever (including the malfunction of an ATM, POS or other equipment or Paul Merchants Limited / service provider system), Paul Merchants Limited will notify the same to the Cardholder and will deduct the excess funds received by the Cardholder from the card funds upon such terms and conditions as Paul Merchants Limited may specify. Paul Merchants Limited reserves the right to require the Cardholder, upon notification, to immediately make payment of such excess funds upon such terms and conditions as we specify.

FOREIGN CURRENCY TRANSACTIONS/ CONVERSION RATE

  1. You can ask the Branch for the exchange rate before making a load or a reload transaction. Foreign exchange rates are subject to variation and the rate that applies one day will not necessarily be the same on any other day.
  2. There are five (5) instances where foreign exchange rate will apply:
    1. Initial load (s) or reload (s), where funds are loaded in foreign currency
    2. Where you refund the available balance of the Card.
    3. POS transactions, where the transaction is in a currency that is not one of the Currencies available on the Card
    4. ATM withdrawals where the Local Currency is not one of the Currencies available on the Card.
    5. Where funds are allocated from one Currency to a different Currency.
  3. If an ATM withdrawal, a POS transaction or an online transaction is made in a currency which is different to any of the available Currencies on the Card, or exceeds the relevant available Currency balance on the Card, the amount will be funded by converting the transaction amount into the next available Currency balance on the Card in the order set by you at the time of card issuance or subsequently set by you through cardholder portal. The foreign exchange rate used is the rate determined by MASTERCARD to be the wholesale rate or the government mandated rate in effect on the day the Transaction is processed by MASTERCARD, plus the Currency Conversion Fee.
  4. If you close the card or request encashment of the Card Balance, these funds will be converted into Local Currency (Indian Rupee). The foreign exchange rate used for this is set and determined by the Paul Merchants Limited Branch and varies each day. You can also contact the Paul Merchants Limited for more information on the applicable exchange rate.

ENCASHMENT OF UNSPENT FUNDS

You may cash out the unspent Card Balance, only after a minimum gap of 10 days from date of last transaction done on your card to ensure all presentments are effected, at an Paul Merchants Limited Branch by submitting Card Refund Form along with a copy of passport and such other documents as required by us from time to time. If still any presentment is done by the merchant after 10 days you will be liable to pay the same on demand by Paul Merchants Limited onto the Card. Payment will be in Indian Rupees and the exchange rate will be determined by the Paul Merchants Limited Branch. A fee may be charged by the Paul Merchants Limited Branch for this service. Please check with the Paul Merchants Limited Branch.

In case if your Card has been issued at the request of your employer for business-related travel, you agree that the authorized employee of the Company can encash any unspent funds subject to conditions mentioned above regarding late presentment, the company will be liable to pay the same on demand by Paul Merchants Limited onto the card.

TERMINATION/ CANCELLATION OF CARD

  1. Paul Merchants Limited reserves the right to cancel/ withdraw the card or any of the other services offered at any time without prior notice and without assigning any reason whatsoever.
  2. In the event where you decide to surrender the PAUL MERCHANTS GLOBAL CURRENCY CARD, the Card would automatically stand cancelled upon such surrender. You must immediately cease to use the card and destroy and return all Secondary cards (if any) that are linked to the Card Balance. In case of any outstanding Card transaction that have not yet been debited to the account, the same will be netted off from the balance prior to Paul Merchants Limited refunding the balance amount.
  3. The cardholder will be responsible for all the charges/ debits incurred on the card whether or not the same are a result of misuse/ fraudulent use and whether or not the Paul Merchants Limited has been intimated of the destruction of the card.
  4. The card is the absolute property of Paul Merchants Limited and must be returned to of Paul Merchants Limited immediately & unconditionally upon request. Please ensure that the identity of the concerned officer of Paul Merchants Limited is established by you before handing over your card.
  5. Paul Merchants Limited shall be entitled to terminate the Card facility with immediate effect and the Card shall be returned upon the occurrence of any of the following:
    1. Death of the Cardholder.
    2. Failure to comply with the Terms and Conditions herein set forth.
    3. An event of default under an agreement of commitment entered into with Paul Merchants Limited.
    4. The Cardholder becoming the subject of any bankruptcy, insolvency proceedings or proceedings of a similar nature.
    5. Paul Merchants Limited reserves the right to withdraw PAUL MERCHANTS GLOBAL CURRENCY CARD program for any reason whatsoever.
  6. The card should be returned to Paul Merchants Limited prior to the date upon which any changes are to take effect, in case of the Cardholders rejection of any of the proposed changes to the features, change of terms and conditions applicable to the Card.

CHANGING THE TERMS & CONDITIONS

Paul Merchants Limited reserves the right to interpret, change, amend and delete at any time, these terms and conditions, features and benefits offered on the Card, including, not limited to, charges which affect existing balances, charges or rates or/ and methods of calculation. PERSONAL DATA

  1. You must let our Branch know immediately if you change your name, address, phone number or email address.
  2. We may contact you by telephone, letter, SMS or email or by other means using the contact details provided to us by you.
  3. By purchasing the Card and using it, you consent to us and our service providers processing the information we collect from you (”Personal Information”), when we provide you with the Customer Care, under the Agreement.
  4. Your Personal Information may be disclosed by us and/ or our service provider to third parties to enable us to provide the Card Services and for data analysis (including market research), anti-money laundering, and detection of crime, legal compliance, and enforcement and fraud prevention purposes/ CIBIL.
  5. Your Personal information may be processed outside of the country of purchase, but all service providers are required to have adequate safeguards in place to protect your Personal information.
  6. You agree that we may contact you about other products and services provided by us. If you no longer wish to receive this information, please contact our Customer Care.
  7. To aid us in the provision of the Customer Care and improve our service, telephone calls may be recorded and/ or monitored.

LIABILITY CLAUSE

  1. In no event we will be liable for any kind of damages consequential or indirect damages (including lost profits), extraordinary damages, or special or punitive damages.
  2. We will not be liable to you in respect of any losses you or any third party may suffer in connection with the Card, arising directly or indirectly out of any misstatement, misrepresentation, error or omission in any details disclosed by us and/ or our suppliers.
  3. We are not responsible for:
    1. Ensuring that ATMs and POS terminals will accept the Card.
    2. Any loss or inconvenience caused by local regulations or because of the lack of uniformity in local regulations or facilities available at ATMs and POS terminals and/ or fees or charges levied directly by any ATM and/ or POS terminal operators.
    3. Any merchant error in processing a transaction, we will not be liable to you for any non-acceptance of the Card, for disputes, including but not limited to, the quality of goods or services purchased on the Card or any additional fees charged by the operators of ATM and/ or POS terminals.
  4. Except as otherwise set out in the Agreement, any liability we have to you is equal to the balance on the Card at any given time.
  5. You agree to pay us for any losses, damages, claims or expenses (including reasonable attorney fees) we incur due to your failure to comply with the Agreement.

COMPLIANCE WITH APPLICABLE LAWS, RULES AND REGULATIONS

  1. Possession and utilization of the Card by the Cardholder is required to be in accordance with all the applicable laws (including the Foreign Exchange Management Act of India), rules, regulations and directions issued by the Reserve Bank of India or other appropriate authority under any law in force from time to time.
  2. The Card may be used outside India, subject to applicable laws, rules and regulations in force from time to time in India and subject to such restrictions/ limitations under the applicable laws, rules and regulations from time to time in the country where the Card is used.
  3. The Cardholder shall be solely responsible and liable to the concerned authorities in the event of any violation of the applicable law, rules and regulations in force from time to time. We will not be liable for any direct, indirect or consequential loss or damages arising from or related to the non-compliance by the Cardholder with any applicable laws, rules and regulations in force from time to time.
  4. The Cardholder hereby indemnifies and agrees to hold Paul Merchants Limited its Directors and Officers indemnified against all actions, claims and costs, charges and expenses arising out of or as a consequence of the usage of the card by the Cardholder or Cardholder not complying with the applicable laws, rules and regulations in force from time to time.
  5. In case the Card is cancelled (or its use suspended), whether on account of non-compliance with the applicable laws, rules and regulations in force from time to time or otherwise, Paul Merchants Limited will not be held responsible for any use/ attempted use of the Card, resulting in the Card being dishonoured or otherwise. The risk of honouring a Card that is cancelled and/ or suspended on its presentment is of such person and/ or of the Cardholder in the individual capacity.

LAW, JURISDICTION AND LANGUAGE

  1. The disputes, which arise under these terms and conditions, shall be governed by Indian law and subject to the exclusive jurisdiction of the courts of Chandigarh.
  2. We will communicate with you in English and the terms are available in English only.

GOVERNING LAWS

  1. The laws of India govern these terms and conditions as also the use of the Card by the Cardholder subject, however to the Cardholder being subject to applicable laws, rules and regulations of India or such other country occasioned by use of the Card outside India. The Parties hereby agree that any claim, legal action and proceeding arising out of these terms and conditions for the Card instituted by the Cardholder (and/ or any persons claiming through or under the Cardholder) shall be brought in the courts or tribunals at Chandigarh in India and the Parties shall irrevocably submit themselves to the jurisdiction of such courts and tribunals.
  2. Each of the provisions of these terms and conditions is severable and distinct from the others and if at any time, one or more of such provisions is or become illegal or unenforceable in any respect under the laws of any jurisdiction, the legality, validity or enforceability of the remaining provisions shall not be affected in any way.
  3. No act, delay or omission by us shall affect its rights, powers and remedies under the Terms or other further exercise of such rights, powers or remedies. The rights and remedies under these Terms are cumulative and not exclusive of other rights and remedies provided by law.

ASSIGNMENT OF RIGHTS

You acknowledge that Paul Merchants Limited may assign, transfer or convey any or all its rights and obligations in respect of the PAUL MERCHANTS GLOBAL CURRENCY CARD to any third party as it may deem fit in its sole discretion without obtaining concurrence of the Cardholder.

DISPUTES

  1. Any charge slip or other payment requisition signed by the cardholder and received from a Merchant Establishment for payment shall be conclusive proof that the amount recorded on such charge slip or other requisition was properly incurred by the Cardholder by the use of Card except for such charge slips or payment requisitions which have been signed on a date subsequent to Cardholder’s notification to Paul Merchants Limited as to an unauthorized transactions having being effected through use of the Card and/ or the PIN having been otherwise misused, lost, or stolen and Paul Merchants Limited having successfully blocked such card and/ or PIN. Paul Merchants Limited will not be answerable for any transactions undertaken on the Card before Cardholder’s notification to Paul Merchants Limited
  2. Should the Cardholder choose to disagree with the charge/ amount indicated in his or her transaction history pertaining to the card, the same should be communicated to Paul Merchants Limited as soon as possible but no later than 30 (thirty) days from the date of transaction, failing which it would be construed that all charges/ amount are entirely in order and acceptable to the Cardholder. In any other case, if the cardholder believes that any amount has been erroneously debited to any of his/ her wallets in the card, the cardholder should forthwith notify the same to Paul Merchants Limited. On receipt of such information, Paul Merchants Limited, basis its internal policies, may choose to initiate an investigation to resolve the disparity as claimed by the Cardholder. If on completion of investigation, Paul Merchants Limited is satisfied that the charge was correctly debited to the card, Paul Merchants Limited will communicate the same to the cardholder and may debit fee and/ or additional charges pertaining to the investigation.
  3. Disputes, as raised by the cardholder, may be rejected by Master Card and/ or the Acquiring Bank basis their existing dispute and chargeback rules and/ or for non-provision of sufficient documents/ information/ proof etc. regarding such disputed transactions. Paul Merchants Limited will not be liable/ responsible for any rejection of disputes by Master Card and/ or Acquiring bank.

CARDHOLDER’S INDEMNIFICATION OBLIGATION

  1. In consideration of Paul Merchants Limited providing you with the card and related facilities, you hereby agree to indemnify and keep Paul Merchants Limited its Directors and Officers indemnified from and against all actions, claims, demands, proceedings, losses, damages, personal injury, costs (including legal costs), charges and expenses whatsoever which Paul Merchants Limited may at any time incur, sustain, suffer or be put to as a consequence of or by reason of or arising out of: (i) providing you the said facility of the card (ii) your negligence, mistake or misconduct (directly or indirectly). (iii) breach or non-compliance of these terms and conditions (iv) fraud or dishonesty relating to any transaction done by you (v) and ATM/ POS machine error or failure or other mechanical/ system error/ failure (vi) collection of all money due and payable (including applicable costs, charges and fees) by you. (vii) Usage of the card by you in any manner.
  2. Additionally, you also agree to indemnify and agree to hold Paul Merchants Limited its Directors and Officers indemnified against all actions, claims, costs, expenses and charges arising out of or as a consequence of you not complying with applicable laws, rules and regulations in force from time to time.

MULTICURRENCY PREPAID CARD WALLET FEATURE

  1. A cardholder can load maximum 9 currencies at a time.
  2. For every Currency, a cardholder can have only one single wallet defined on a card.
  3. The cardholder should note that cumulative wallet available balance is validated for all the

wallets except for wallets with closed as well as “freeze” status.

  1. The cardholder cannot have close loop wallets as multi-currency programs are supported by open loop public networks like MASTERCARD.
  2. The cardholder should note that one default wallet will be created by the system in the currency defined in multicurrency program. All the signup and maintenance fees will be charged to this wallet provided fees are configured in the currency of the default wallet.
  3. The cardholder can access Wallet summary from the mobile app or cardholder portal.

Note –

  1. Additional fees for ATM transactions may be levied by the bank owning the overseas ATM used.
  2. Charge slip retrieval is charged for any transaction details being fetched (for a dispute raise) post the transaction happened.
  3. Chargeback fee is a fee raised by the processor for any dispute investigation, it would be only charged for legitimate dispute cases.
  4. International SMS alert charges: Debited every 30 days from the highest order wallet with sufficient balance. In case of insufficient balance, domestic mobile no. will be updated by default.
  5. Card inactivity fee would be calculated once for every 180 days of inactivity
    Cash @POS is a facility through which Paul Merchants Global Currency Card can withdraw cash by swiping their card at merchant outlets.
  6. Cross currency fee is applied at the time of swiping or withdrawing a currency which is not available in wallet or the available amount is less than transaction value.
  7. All fees and charges mentioned above are exclusive of taxes. Goods and Service Tax (GST) rate of 18% will be levied.
  8. Cardholders are advised not to use prepaid forex card for pre-auth transactions (Hotel Check-in).
  9. The fund in such instances gets blocked and are released in max 45 days post final settlement.
